Expert Determination Case Studies

The Warring Solicitors (Surely Not!)

With one of Chris’s private appointments, the continuing partners in a law firm could not agree with the senior partner how much he should be paid on his retirement. The dispute went to arbitration, where a well-known arbitrator took ages to make a decision, charging a fee of more than the amount in dispute!

But his decision was only on principles, and Chris then had to be appointed to determine quantum. He could have settled the whole matter under expert determination, for about a quarter of the overall cost.

A mediator who is also an accountant is without doubt a benefit!
